View Full Version : Copyright Infringement Related to Ichigo's Midi?

I've been hit by youtube because some guy username bar8823 is claiming that one of my HD/HQ piano tutorial which titled Anohana - Secret base 10 years after,he uploaded a youtube cover,and i uploaded a midi synthesia + VST piano sound and he's claiming that i've violated the copyright rules.
And here's the key,the midi i downloaded its from this site,bar8823 didn't share any of the material or arrangement details is belong to him,and if i recall correctly,this song is transcribe or arranged by tree_kun,if the midi/arrangement is belong to him,and he don't want anyone to copy his video/arrangement,why does he uploaded a midi file in the 1st place,he should just keep it from himself,and the thing is,only MINE is being submitted to youtube centre,while others had the same exactly piano tutorial didn't hit any.Any other suggestion on how to do this?
because,if everyone shared their arrangement in ichigo,and i tutorial every midi from ichigo,so does that mean everyone of them can submit that i violated the copyright laws? And sue me and earn a fking $ by sueing me?

While I am sorry you are having legal issues, if you review Ichigo's legal policy (http://ichigos.com/legal), you will see that there are two acceptable uses of the site's media without written consent:

Fair Use, in terms of performance or education; which, if challenged, you must meet the Fair Use requirements found in 17 USC § 107 (http://www.copyright.gov/title17/92chap1.html#107)
Unreleased and/or undistributed personal archive


Properly put, when the transcriber/composer of Ichigos share the music on the main site, they fall under this legal contract. Most composers/transcribers are open about their works and do not act on illegal distribution of their work, but there are several that wish to retain full rights to their works and wish to have control over both open distribution and attribution. These latter authors have, by uploading their works, permitted Ichigos to use their work in accordance to our legal policy when they decide to upload their works to the main site. It is up to the end user to properly adhere to these legal terms; and by no way is Ichigos liable for any actions taken outside of the legal contract.

Note that this legal policy is also applied to forum postings of author's original works on this site, unless explicitly mentioned otherwise by the author.
